The secularity of the Brazilian State brings the issue of individual freedom provided for in the Federal Constitution of 1988, because at various times the conflict of legislative and executive powers ends in the judicialization of issues from the public and private spheres. The attribution of such questions highlights ministers of the Supreme Court, whose decisions demean social values and go beyond hermeneutics. What needs to be preserved is individual freedom and not the encedon of that freedom.
