Abstract

The present work arises from the fact that remnants of African slaves in Brazil still live on the margins of social rights, being deprived in some cases of medical, educational, safety and decent housing. Since the Golden Law exists in fact, but not in law, where an ill-resolved abolition extends for more than 120 years. The bibliographic arsenal supports the fact that slavery has conditioned the black individual to a situation of subordination and obedience, and even fighting against it, such an idea has materialized in society. The problematic of this study refers to the remnants inherent to the situation of slaves that remain in that group. In this way it is evident that the Constitutional Guarantees related to the Dignity of the Human Person have not yet reached this social minority in an effective way. To obtain this result, the qualitative quantitative methodology was used through theoretical reference analysis and field research. At the end of the study it is verified that the quilombola community does not yet live in conditions equivalent to the list of guarantees provided for in the Federal Constitution and that the public policies employed need improvement in order to become truly effective.
